Gift Card Terms and Conditions
The following are the terms and conditions applicable to your Gift Card balance and Gift Cards. By purchasing, accepting, or using a Gift Card, you agree to be bound by these terms and conditions on behalf of yourself and all members of your household and others who purchase, accept, or use a Gift Card under your account.

1. Gift Cards; Gift Card balance; Redemption
Gift Cards are issued by Ceridian Stored Value Solutions, Inc., a Delaware corporation (“Gift Cards”). The Gift Card has no value until activated by a cashier or retailer. To check your Gift Card balance, visit fiveguys.com/gift-cards/ or call us at (877) 729-1815. Purchases are deducted from your Gift Card balance. The balance you receive when inquiring through the website or telephone number is an estimate based on available transaction data. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed. Any unused Gift Card balance will remain associated with your Gift Card. If a purchase exceeds your Gift Card balance, the remaining amount must be paid with another payment method.
Gift Cards may only be redeemed toward the purchase of eligible goods in the United States at participating Five Guys locations, at www.fiveguys.com, or in our mobile application. To redeem at participating Five Guys locations your Gift Card must be presented at the time of order. If you do not have sufficient funds on your Gift Card, you will receive a message prompting you to provide an alternate method of payment to continue with your order. Invalid or unidentifiable Gift Cards or Gift Card numbers will not be redeemed.
2. Limitations
Your Gift Card balance cannot be: used to purchase other Gift Cards, prepaid open loop cards, or certain third-party gift cards. Gift Cards cannot be reloaded; resold; used for payment outside of participating locations, order.fiveguys.com, and/or our mobile application; used for unauthorized advertising, marketing, sweepstakes, promotional or commercial purposes; redeemed for more than face value; transferred for value; redeemed for cash (except to the extent required by law); returned for a cash refund (except to the extent required by law); or used in a manner otherwise prohibited by these terms or our Terms of Use.
3. Risk of Loss
The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission of the Gift Card to the purchaser or designated recipient, or our delivery to the carrier, whichever is applicable. Gift Cards must be obtained from Five Guys or an authorized third party, and you are responsible for safeguarding your Gift Card balance or Gift Card from unauthorized use. We are not responsible if any Gift Card is lost, stolen, or destroyed, or if your Gift Card balance or any Gift Card is used without your permission. Five Guys is not responsible for, and assumes no liability to you for, any unlawful conduct or fraud by any third party associated with any Gift Card. If you suspect that someone has copied or stolen your Gift Card, contact Contact Us | Five Guys immediately. Gift Cards will not be replaced if lost or stolen without proof of purchase. Gift Cards have cash value and should be safeguarded accordingly.
4. Use of Gift Card balance or any Gift Card in Violation of these Terms and Conditions
By using a Gift Card you agree to comply with these terms and conditions, and not to use a Gift Card in any manner that is misleading, deceptive, unfair, or otherwise harmful to Five Guys, its affiliates, or its customers. We reserve the right, without notice to you, to void Gift Cards (including as a component of your Gift Card balance) without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that a Gift Card is obtained, used, or applied (or your Gift Card balance is applied to a purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.
5. Limitation of Liability
TO THE FULL EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS OR YOUR GIFT CARD BALANCE, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT GIFT CARD.
6. Disputes
Any dispute or claim relating in any way to Gift Cards or your Gift Card balance will be resolved by the dispute resolution terms in the Five Guys website Terms of Use.
7. General Terms
The Five Guys website Terms of Use apply. No fees apply to Gift Cards and, except where permitted by applicable law, the Gift Card balance does not expire. We reserve the right to require additional verification of your identity, Gift Card or account ownership, or provision of an additional payment instrument, before you are able to apply a Gift Card to your account or your Gift Card balance to a purchase. The Gift Card is not a credit, debit, or charge card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it. No implied warranties attach to the Gift Card. We reserve the right to correct the Gift Card balance if we believe that a clerical, billing, or accounting error has occurred. You also agree that we may deactivate, cancel, or suspend any Gift Card and suspend any associated Gift Card funds if we suspect fraud, unlawful activity, or improper Gift Card use. You agree that You will not use a revoked Gift Card. When you purchase, receive, or apply a Gift Card to your account, or your Gift Card balance to a purchase, you agree that the laws of the Commonwealth of Virginia, without regard to principles of conflict of laws, will govern these terms and conditions and any dispute that may arise between you and Ceridian Stored Value Solutions, Inc., Five Guys Holdings, LLC, and their respective parents, subsidiaries, or affiliates related to your use of a Gift Card or your Gift Card balance. We reserve the right to change these terms and conditions without notice, from time to time at our sole discretion, and any amendment will be effective as of the effective date set forth in such amendment posted on this webpage. All terms and conditions are applicable to the extent permitted by law. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.
